1. Agreement to Terms

By accessing and using the Galonia website (galonia.be), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Galonia's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Modifying or copying the materials
Using the materials for any commercial purpose or for any public display
Attempting to decompile or reverse engineer any software contained on the website
Removing any copyright or other proprietary notations from the materials
Transferring the materials to another person or "mirroring" the materials on any other server
Accessing the website through automated means without permission

3. Product Information & Availability

Galonia provides product information on the website to the best of our knowledge. We strive to ensure accuracy but make no warranty regarding:

Product descriptions, images, or specifications
Pricing information (prices are subject to change without notice)
Product availability or stock levels
Characteristics of plants, including growth rates or hardiness

We reserve the right to discontinue any product at any time and to correct any pricing errors.

4. Order Placement & Confirmation

When you place an order on Galonia:

You acknowledge that your order constitutes an offer to purchase the products
We have the right to accept or reject your order for any reason
An order confirmation email does not constitute acceptance of your order
We will notify you if we cannot fulfill your order
Prices are in Euros (EUR) and include any applicable taxes unless otherwise stated

5. Payment & Pricing

Payment Processing: Payments are processed securely through Stripe. By placing an order, you authorize Galonia to charge your payment method for the full order amount. Stripe's terms and privacy policy apply to payment processing.

Pricing: All prices are displayed in Euros and are subject to change. We reserve the right to limit quantities and correct pricing errors. If a product's price is incorrect due to a typographical or technical error, we will not be obligated to sell it at that price.

Taxes: You are responsible for any applicable taxes based on your location.

6. Pickup & Delivery

Pickup Location: All orders are available for pickup at:

Pickup Hours: Saturday & Sunday, 10:00 - 16:00

Pickup Deadline: Orders must be picked up within 30 days of the order confirmation date. Products not picked up after 30 days may be discarded or resold at Galonia's discretion without refund.

No Shipping: Galonia does not currently offer shipping services. All purchases are for local pickup only.

7. Product Condition & Plant Care

Plant Condition: Galonia provides healthy Paulownia saplings and plants. Upon pickup, customers should immediately inspect their order for any damage or defects.

Post-Purchase Care: Plant health after pickup is the responsibility of the customer. Galonia is not responsible for plant death, damage, or poor growth due to:

Improper watering, fertilizing, or soil conditions
Environmental factors (frost, drought, pests, disease)
Planting techniques or timing
Inadequate sunlight or unsuitable growing conditions
Weather events after delivery to the customer

8. Returns & Refunds

Return Policy: Due to the perishable nature of plants, Galonia does not accept returns once products have been picked up.

Defective Products: If a product arrives damaged or defective (determined by Galonia at pickup), we will:

Provide a replacement if inventory allows
Issue a refund for the defective item if replacement is not available
Require proof of the defect (photo) within 48 hours of pickup

Refund Process: Refunds, if applicable, will be processed to the original payment method within 7-10 business days.

No Refunds for Change of Mind: Galonia does not offer refunds for purchases where the customer changes their mind or the product does not meet personal expectations.

9. Disclaimer of Warranties

The materials on Galonia's website are provided on an 'as is' basis. Galonia makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Galonia does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

10. Limitations of Liability

In no event shall Galonia or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Galonia's website, even if Galonia or an authorized representative has been notified orally or in writing of the possibility of such damage.

The maximum liability of Galonia for any claim related to products or services shall not exceed the amount paid for the product in question.

11. Accuracy of Materials

The materials appearing on Galonia's website could include technical, typographical, or photographic errors. Galonia does not warrant that any of the materials on its website are accurate, complete, or current. Galonia may make changes to the materials contained on its website at any time without notice.

Galonia has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Galonia of the site. Use of any such linked website is at the user's own risk.

Galonia may revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

14. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Belgium, and you irrevocably submit to the exclusive jurisdiction of the courts located in Belgium.

15. Dispute Resolution

Informal Resolution: Before initiating any legal action, you agree to contact Galonia at contact@galonia.be to attempt to resolve any dispute informally.

Mediation: If informal resolution fails, you agree to participate in mediation before pursuing litigation. Mediation shall take place in Belgium.

Jurisdiction: Any legal action or proceeding related to these terms shall be brought exclusively in the courts of Belgium.

16. Severability

If any provision of these terms of service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
